Will the Act Affect My Business?

If you own or manage a commercial property, you may need to comply with the Clean Buildings Performance Standard (CBPS). The requirements vary based on the size of your building and are categorized into Tier 1 and Tier 2.

  • Tier 1 Buildings: Includes buildings where the combined nonresidential, hotel, motel, and dormitory floor areas exceed 50,000 gross square feet (excluding parking garages).
  • Tier 2 Buildings: Includes buildings with a combined multifamily residential, nonresidential, hotel, motel, and dormitory floor area between 20,000 and 50,000 gross square feet. Multifamily residential buildings over 50,000 square feet (excluding parking garages) also fall under Tier 2.

Compliance Deadlines

If your building is subject to CBPS, here are the key reporting deadlines:

Tier 1 Buildings:

  • By June 1, 2026: Buildings over 220,000 sq. ft.
  • By June 1, 2027: Buildings between 90,001 and 220,000 sq. ft.
  • By June 1, 2028: Buildings between 50,001 and 90,000 sq. ft.

Tier 2 Buildings:

  • By July 1, 2027: Buildings between 20,001 and 50,000 sq. ft., including all multifamily residential buildings over 20,000 sq. ft.
